关于相对集中行政处罚权有关问题的思考

摘　　要：在我国,行政处罚权相对集中模式是一种新兴的处罚权配置方式,其通过将原本分散于各个部门的行政处罚权进行整合,从而实现权力的科学配置和高效运行。相对集中行政处罚权是顺应我国法治化进程的必然选择,有助于解决“权责不一、多头执法”等问题,实现行政处罚权的规范化和专业化。我国的法治建设为相对集中行政处罚权提供制度支撑,改革实践为其积累了经验,社会诉求是其改革动力。在推进过程中,仍面临法律依据不完善、部门利益难以协调、执法机构职能重叠、执法能力仍不足的困境。需加快完善相关法律法规、合理划分部门职责、统筹推进体制改革、加强队伍能力建设,集中行政处罚权才能真正落到实处。In China,the relatively centralized mode of administrative punishment power is a new way of punishment power allocation.It integrates the administrative punishment power originally dispersed in various departments,so as to realize the scientific allocation and efficient operation of the power.The relative centralization of the power of administrative punishment,which is the inevitable choice in line with China’s process of legal system construction,helps to resolve issues such as“inconsistent responsibilities and rights,and multi-subject law enforcement”,making the power of administrative punishment standardized and specialized.The construction of the rule of law in our country provides institutional support for the relatively centralized power of administrative punishment,reform practices accumulate experience for it,and social demands are the driving force for its reform.However,in the process of its promotion,there are still some challenges such as inadequate legal basis,ill ordination of department interests,overlapping functions of enforcement agencies,and insufficient enforcement capacities.It’s necessary to accelerate the improvement of related regulations,reasonably divide departmental responsibilities,comprehensively promote institutional reform,and enhance the capacities of the enforcement team,so that centralized power of administrative punishment can be put into practice.
