监察委员会派驻制度的现实困境与理性形塑

摘　　要：在监察全覆盖的时代背景下,监察派驻制度面临紧迫的监察监督地方化、监察监督部门化以及监察监督实质全覆盖的困境等问题。应以充分发挥“派”的权威与“驻”的优势为原则完善监察派驻制度,使派驻监察人员法治化与高效化履行监察监督职权。完善“四个全覆盖”监督格局需要构建并完善巡视监督与派驻监督的联动机制,实现二者优势的发挥,增强监察监督职能发挥的效力。在派驻机构独立性的体系保障上,应明确派驻机构的职责定位,强化派驻机构的垂直管理体制。须明确细化派驻监察机构的监督权限,派驻机构具有权限按管理权限处置实施相对轻微的职务违法行为的公职人员,对实施并非情节较轻的职务违法行为甚至职务犯罪行为的公职人员,须上报派出监察机关统一调查与处置。In the context of the era of full coverage of supervision,the system of supervision and stationing faces urgent challenges such as localization of supervision,departmentalization of supervision,and the dilemma of full substantive coverage of supervision.The principle of giving full play to the authority of“dispatching”and the advantages of“stationing”should be used to improve the system of supervision and stationing,so that stationed supervisors can fulfill their supervisory powers in a legal and efficient manner.Improving the“four full-coverage”supervision pattern requires the construction and improvement of a linkage mechanism between inspection supervision and stationing supervision,so as to realize the advantages of both,and to strengthen the effectiveness of the supervision and supervision functions.In terms of the systematic guarantee of the independence of the stationed institutions,the position of the duties of the stationed institutions should be clarified,and the vertical management system of the stationed institutions should be strengthened.The supervisory authority of the stationed supervisory body must be clearly detailed,and the stationed body must have the authority to dispose of public officials who commit relatively minor functional violations in accordance with its management authority,and to report to the dispatching supervisory body for unified investigation and disposal of public officials who commit functional violations or even functional crimes that are not of a relatively minor nature.
