陆域矿山开发中的国土空间用途管制实践与思考——以湖北省宜昌市为例

摘　　要：宜昌市作为我国矿业大市,矿产资源丰富,矿山类型齐全,地貌类型多样,所涉国土空间用途管制要素众多,矿山开发与国土空间用途管制矛盾十分典型。研究表明,我国陆域矿山开发主要面临两个国土空间用途管制问题,一是受耕地、林地、草地、湖泊等管制要素制约,二是受建设用地用途管制约束。本文结合近年来的实践经验,探索性提出了“矿业权联合审查审批制度+矿业权审批前置制度+矿地联合出让‘三同时’”的采矿权出让新模式,并设计了采矿权出让流程优化方案,以期为统筹化解矿山开发利用与国土空间用途管制的矛盾提供参考。As a major land-based mining development city in China,Yichang city is rich in mineral resources,with complete types of mines and diverse geomorphic types.As a result,mining development involves numerous elements of territorial spatial utilization control and the contradiction between them is very typical in this area.It is found that the process of mining development in terrestrial area of China mainly faces two issues about territorial spatial utilization control.On the one hand,it is constrained by regulatory factors such as arable land,forest land,grassland,lakes,etc.And on the other hand,it is restricted by construction land use control.Combined with the practical experience in recent years,a new mode in transferring mining right,namely"joint examination and approval system of mining rights,pre-approval system of mining rights and'three simultaneous'of joint transfer of mining rights and land",is proposed.Meanwhile,an optimization plan of mining right transfer is designed,which provides a reference for coordinating and resolving the contradiction between mine development and territorial spatial utilization control.
