摘 要:本文主要探讨了公司僵局救济的概念界定和成因,以及我国在公司僵局救济方面存在的问题。其中,立法滞后于当今社会需要、法律适用实践效果不佳、股东自力救济意识不足等问题是我国公司僵局救济面临的主要挑战。最后,本文提出了完善现行立法、强化司法救济和提升公司章程实用性等方面的建议,以期为我国公司僵局救济的完善提供一些思路和方向。With the introduction of the Civil Code,more and more attention is paid to the protection of privacy and personal information.With the rapid development of the Internet,employers in the field of labor continue to exercise their right to know and collect workers’personal privacy information with the help of big data technology,increasing the risk of workers’privacy being violated and causing conflict between the two.In the face of the above problems,labor laws and norms should be improved,the scope of workers’privacy should be clarified according to the specific circumstances,the rules of informed consent should be improved,and the obligation of employers to inform should be clarified.In order to achieve the balance and coordination between the labor management of employers and the protection of workers’privacy rights.
