摘 要:内部行政行为外部化作为行政诉讼受案范围中内部行政行为不能提起行政诉讼的一个例外情形,长期以来饱受学界争议。本文对内部行政行为外部化司法审查标准进行了检视,发现学界和实务界对内部行政行为外部化的界定标准认识不统一,造成审判领域对内部行政行为外部化的适用标准存在困惑。本文从主观主义标准和客观主义标准这两个维度出发,重新厘清内部行政行为外部化司法审查标准,在一定程度上促进内部行政行为外部化认定标准的明确化。不仅有利于保障好行政相对人的诉讼权益,而且有助于行政纠纷实质性化解。The externalization of internal administrative acts,a contentious exception within the realm of administrative litigation admissibility,has long sparked debates among scholars.This paper delves into the judicial review criteria for such externalization and uncovers disparities in comprehension between academia and practice regarding its definition.By adopting both subjectivist and objectivist standards as analytical lenses,this study endeavors to clarify the judicial review framework for externalized internal administrative acts,thereby enhancing clarity in identifying their nature.Such clarification not only safeguards the litigation rights and interests of administrative counterparts but also facilitates the substantive resolution of administrative disputes.
