摘　　要：刑事错案长期困扰着司法系统,它是随着国家的法治进程不断发展产生的。口供相对于实物证据来说,能够全面反映案情,但也存在着虚假性。本文首先对刑事错案和口供的概念进行了界定,探讨了刑事错案的评判标准,并分析了口供与刑事错案之间的关系。通过选取典型的刑事错案案例,深入剖析了案件中的争议焦点,以此揭示口供在刑事诉讼中的作用及其可能带来的问题。在研究中,本文发现目前口供的运用存在口供固定问题、证据形式化、过分重视口供及诉讼效率的问题。针对这些问题,本文提出了以下建议:进一步加强非法证据排除制度的实施,确保口供的合法性;完善口供补强规则,要求在采信口供时必须有其他证据相互印证;提高司法工作人员的职业素养,增强其法律意识和职业道德。通过对刑事错案中口供问题的深入剖析,本文旨在为完善口供的审查机制提供理论依据和实践建议,从而促进司法公正,维护社会公平。The misjudged criminal cases have long troubled the judicial system,which is produced with the development of the rule of law in the country.Compared with the physical evidence,the confession can reflect the facts of the case comprehensively but also has the falsity.This paper first defines the concept of criminal misdemeanor and confession,discusses the criteria for judging criminal misdemeanor,and analyzes the relationship between confession and criminal misdemeanor.By selecting typical cases of misjudged criminal cases,this paper analyzes the controversial focus of the case and reveals the role of confession in criminal proceedings and the problems it may bring.In the research,this paper finds that there are problems in the application of oral confession,such as oral confession fixation,evidence formalization,over-emphasis on oral confession,and litigation efficiency.In view of these problems,this paper puts forward the following suggestions:to further strengthen the implementation of the system of exclusion of illegal evidence,to ensure the legitimacy of confession,to perfect the rule of reinforcement of confession,it is required that there must be other evidence to corroborate each other when a confession is taken,and it is necessary to improve the professional quality of judicial personnel and enhance their legal awareness and professional ethics.Through the in-depth analysis of confession in misjudged criminal cases,this paper aims to provide a theoretical basis and practical suggestions for improving the examination mechanism of confession,thus promoting judicial justice and maintaining social fairness.
