摘　　要：知识产权法能否满足各个主体的需求,不但关乎知识产权的未来,甚至会影响整个社会未来改革的方向。现阶段知识产权人与使用者之间矛盾重重,主要是因为知识产权人垄断其知识产权的行为与社会公众使用知识产品的需求难以平衡。基于上述理由,亟需反思知识产权的负面影响和借鉴域外知识产权利益平衡的经验,以期设计以公正为基础、以秩序为保障、以效益为目标的知识产权法利益平衡原则。应先确定许可效率与传播效率相协调的知识产权利益平衡原则的设计规则,再正确处理限制知识产权权利人与使用者关系的知识产权利益平衡原则的运作规范,最终保证各方能够在不损害对方核心利益的前提下,借助知识产权法利益平衡原则的构建实现各方价值的最大化。Whether the intellectual property law can meet the needs of all subjects is not only related to the future of intellectual property rights,but also affects the future reform direction of the whole society.At present,there are many contradictions between intellectual property owners and users,and the main reason is that it is difficult to balance the behavior of intellectual property owners to monopolize their intellectual property rights with the needs of the public to use intellectual products.Therefore,it is vital to reflect on the negative impact of intellectual property rights and learn from the experience of interest balance of intellectual property rights abroad,hoping to design the principle of balance of interests of intellectual property law based on justice,guaranteed by order and aimed at benefit.Firstly,we should determine the design rules of the principle of balancing the interests of intellectual property rights in coordination with licensing efficiency and communication efficiency.Secondly,correctly handle the principle of balance of interests in intellectual property rights that limits the relationship between the owner and the user of intellectual property rights.Finally,ensure that all parties can maximize the value of each party by means of the construction of the principle of balancing the interests of the other party without damaging the core interests.
