摘 要:劳动法的法典化是社会法学界的热议话题。在现有制度环境与主流理论准备的基础上编撰劳动法典,需解决两个前提性问题,一是如何处理劳动法典与社会法典的关系,二是“求全”与“求纯”的路径选择。有别于“求全”与“求纯”在民法典的立法讨论中呈现互斥关系,“求全”与“求纯”在劳动法典的学术讨论中呈现共存关系,二者结合易走向管制的法典化。法国劳动法典是“求全”发展的他山之石,苏区劳动立法是“求纯”探索的前车之鉴,编撰劳动法典需总结二者的经验教训。编撰劳动法典应秉持社会利益本位,妥善处理覆盖之宽窄、标准之高低、执法之宽严三个问题,避免高管制法典化产生的法治困境。The codification of labor law is a hot topic in social law circles.On the basis of the existing institutional environment and the mainstream theory preparations,the compilation of a labor code needs to solve two prerequisite issues.One is how to deal with the relationship between the labor code and the social code,the other is how to make a choice between ‘pursuing comprehensiveness’ and ‘pursuing purity’.Unlike the mutually exclusive relationship in the legislative discussion of the Civil Code,‘pursuing comprehensiveness’ and ‘pursuing purity’ coexist in the current academic discussions of the labor code,and the combination of ‘pursuing comprehensiveness’ and ‘pursuing purity’ is easy to lead to the codification of regulation.The French Labor Code is an example of ‘pursuing comprehensiveness’ and the Soviet labor legislation is a mirror of ‘pursuing purity’.The compilation of the labor code requires summarizing the experiences and lessons of the two.The compilation of the labor code should adhere to the legal standard of social interests,properly deal with the three issues of coverage,standard and enforcement,and avoid the legal dilemma caused by the codification of regulations.
