数字时代奥运版权保护与运用研究

摘　　要：随着数字技术的发展,奥运版权保护面临的主要挑战包括奥运会赛事的非法直播与转播、网络视频平台奥运版权侵权以及在互联网中违法使用奥林匹克标志等。本文认为,体育赛事转播权是一项综合性权利,涵盖了合同权利和版权(邻接权)。我国《著作权法》于2020年修改后,通过广播组织权和录制者权规范体育赛事非法公开传播更为合理。在判定网络视频平台的版权侵权责任时,考察其商业模式是一个关键因素,对于涉及奥运会的侵权直播或视频内容,平台应主动承担监测和审核的责任,并承担与收益相匹配的证明责任以及自我管理的义务。奥林匹克标志在互联网上的非法使用,包括未经授权的NFT数字藏品使用和网络恶搞等行为,应通过《奥林匹克标志保护条例》进行规范。在数字时代,奥运版权保护需要确立严保护政策导向,构建版权大保护工作格局,突破快保护关键环节,塑造同保护优越环境。With the development of digital technology,the main challenges faced by the copyright protection of the Olympic Games include the illegal live broadcast and rebroadcasting of the Olympic Games,the infringement of Olympic copyright on online video platforms,and the illegal use of the Olympic logo on the Internet.This article argues that the broadcasting rights of sports events are a comprehensive right that encompasses both contractual rights and copyright(neighboring rights).After the amendment of China's Copyright Law,it is more reasonable to regulate the illegal public dissemination of sports events through broadcasting organization rights and recording rights.When determining the copyright infringement liability for online video platforms,the business model is a key factor.With regard to the infringement of live broadcasts or video content related to the Olympic Games,the platform should proactively assume the responsibility of monitoring and reviewing,and should bear the burden of proof that matches the revenue,as well as the obligation of selfmanagement.The illegal use of Olympic Symbols on the Internet,including unauthorized use of NFT digital collections and network spoofing,should be regulated through the Regulations on the Protection of Olympic Symbols.In the digital age,copyright protection for the Olympic Games requires the establishment of strict protection policy guidance,the construction of a comprehensive copyright protection work pattern,breakthroughs in key links of fast protection,and the shaping of a superior environment for protection.
