摘　　要：文章阐述绝版图书数字化的现实价值,分析绝版图书数字化面临的合理使用制度作用有限、法定许可制度难以适用、集体管理制度亟待完善等障碍,总结北欧的延伸性集体管理制度和法国的推定集体管理制度经验,提出我国绝版图书数字化版权规则构建策略,即开展绝版图书名录编制与审查工作,加强门户网站与数据库建设,构建权利主体自由退出及鼓励促进机制,设置相关方对话磋商机制。The article elaborates on the practical value of digitizing out-of-print books,analyzes the obstacles faced by the digitiza-tion of out-of-print books,such as limited role in the reasonable use system,difficulty in applying the statutory licensing system,and urgent need to improve the collective management system.By summarizing the experience of the extended collective management system in Northern Europe and the presumed collective management system in France,the article proposes strategies for constructing copyright rules for out-of-print books in China,including carrying out the compilation and review of out-of-print book catalogs,strengthening the construction of portal websites and databases,establishing mechanisms for the free exit and encouragement of rights holders,and setting up mechanisms for dialogue and consultation among relevant parties.
