权力规制视角下监察调查权的运行逻辑与功能调适

摘　　要：决策权、监督权和执行权并置的权力规制理论为观察监察调查权提供了新的视角。这一理论在总体目标、权力结构、权力运行等方面与监察调查权规范化建构具有内在的一致性。以此为理论基点,可以发现,在纪检监察合署办公的组织结构下,纪法双施双守的内生逻辑铸造了监察调查权结构的整体性,集体决策和内部审批的现实样态贯穿于监察调查权的全过程。但在集中高效的一体化运行模式下,监察调查活动仍可能出现决策失灵、执行扩张和内外部监督失衡等三个维度的潜在风险。借助权力规制的理论框架,可以从增强监察法律规则的供给、优化监察调查程序的权力配置、完善权利平衡机制等方面构建同频共振的内部平衡结构,并主要围绕监察机关与公检法三机关的关系形塑外部权力的监督制约格局,从而调适和规范监察调查权的运行。The theory of power regulation,encompassing decision-making,oversight,and executive authority,introduces a fresh perspective on examining the investigative powers of supervisory bodies.This theory aligns cohesively with the conventional framework of investigative powers in terms of overarching goals,power structures,and procedural mechanisms.Drawing from this theoretical framework,it becomes apparent that within the organizational setup of the joint office of discipline inspection and supervision,the fundamental principle of upholding both disciplinary measures and legal compliance shapes the integrity of investigative power structures.Collective decision-making and internal approval are integral components throughout the investigative process.Despite the centralized and efficient integrated operational model,investigative activities may encounter potential risks across three dimensions:decision-making errors,expanded execution,and imbalances in internal and external oversight.By utilizing the theory of power regulation,a harmonious and internally balanced structure can be established by enhancing supervisory legal norms,optimizing the operational framework of investigative powers,refining mechanisms for rights balance,and focusing on refining the external power supervision dynamics between supervisory bodies and the public security,procuratorates,and courts.This approach aims to adjust and standardize the functioning of supervisory investigative powers.
