摘 要:警务自主性的获得与警务权力的扩张息息相关,但两者并非简单或绝对的正相关。我国警务发展大致经历了以管控为导向-以管理为导向-以治理为导向三个时期,在这一过程中,警务在专断权力和基础权力的作用下不断转型和提升,警务自主性也随之发生变化。但无论哪种类型的权力运行都面临限度收紧的难题,需要分殊制衡。通过适度发挥警务专断性权力中的管控能力和基础性权力中的服务能力,将警务自主性限定在一个合理、规范且能动的界限内,强调国家对社会的嵌入以实现国家与社会的有效链接,为协同警务的发展提供能力保障。The acquisition of police autonomy is closely linked to the expansion of police power,but the relationship is not simply or absolutely positive.In China,police development has gone through three phases:control-oriented,management-oriented,and governance-oriented.During this process,police functions have transformed and evolved under the influence of both discretionary and foundational power,altering police au-tonomy.Regardless of different types,all powers are going to be limited and balanced.By appropriately lever-aging control capabilities within discretionary power and service capabilities within foundational power,police autonomy can be confined to a reasonable,regulated,and dynamic scope.This approach emphasizes state in-tegration into society,enabling effective linkage between the state and society and providing capacity support for collaborative police development.
