船舶噪声污染防治法律问题研究

摘　　要：通过对船舶噪声污染防治立法现状进行分析,发现现行船舶噪声污染防治的不同位阶存在法律之间衔接不紧密、法律条款之间存在法律冲突、部分法律条款设置不科学等问题,并相应提出将噪声污染防治纳入船舶防污染法律体系,补充、完善船舶噪声污染防治条款,允许设置差异化的船舶噪声污染防治规定,将《内河避碰规则》与船舶噪声污染防治的要求进行协调等若干建议。By analyzing the current status of the legislation for ship noise pollution prevention and control,the paper concludes that there are problems such as poor interconnection between laws of different hierarchical levels,legal conflicts between provisions,and unscientific provisions in the current laws on ship noise pollution prevention and control.In view of the above,it suggests that noise pollution prevention and control be incorporated into the legal system of ship pollution prevention and control,and that the provisions on ship noise pollution prevention and control be supplemented and improved.It also proposes that differentiated regulations on ship noise pollution prevention and control should be allowed,and that the requirements on ship noise pollution prevention and control be coordinated with those of the Regulations on the Collision Prevention in Inland Rivers.
