监狱人民警察执法风险防范及免责制度的建构

摘　　要：监狱民警是刑罚的执行者,在对罪犯实施教育改造、劳动改造及日常管理过程中,存在着合法行使职权风险、刑事责任风险、人身安全风险、精神受损风险、名誉荣誉受损风险等执法风险,如果由于处置不当而造成不良影响,就可能受到党纪政纪处分,甚至被追究刑事责任。监狱民警执法风险的产生,是由少部分罪犯过度维权、部分民警对执法风险缺乏警醒意识,以及执法业务素质不高等造成的。只有完善监狱民警执法活动相关的法律法规、维护监狱人民警察的执法权威、确立监狱民警依法履职免责的条件等,才能有效防范执法风险。Prison police officers are the executors of criminal punishments.In the process of implementing education and reform,labor reform,and daily management of criminals,there are risks of legal exercise of powers,criminal responsibility,personal safety,mental damage,reputation and honor damage,and other law enforcement risks.If they cause adverse effects due to improper disposal,they may be subject to party and government discipline,and even criminal responsibility.The occurrence of law enforcement risks by prison police is caused by a small number of criminals excessively safeguarding their rights,a lack of awareness of law enforcement risks among some police officers,and low professional quality in law enforcement.Only by improving the relevant laws and regulations on law enforcement activities of prison police,maintaining the law enforcement authority of prison police,and establishing conditions for prison police officers to perform their duties in accordance with the law and avoid liability,can law enforcement risks be effectively prevented.
