摘　　要：全国人大常委会解释宪法的职权具有专属性,具体包括三重内涵:其一,全国人大常委会解释宪法具有专门性。《宪法》第67条第1项规定的“解释宪法”职权并不当然地依附于或者包含于同项所规定的“监督宪法的实施”的职权。其在性质和功能上不能为其他职权所替代。在宪法监督之外,全国人大常委会仍然有单纯行使宪法解释权的制度空间。其二,全国人大常委会解释宪法的效力具有确定性。全国人大可以监督全国人大常委会行使宪法解释权,但为了维护宪法解释的确定性,全国人大应当尊重全国人大常委会所作宪法解释的权威性。其三,全国人大常委会作出的宪法解释对全国人大亦具有一定约束力,可在一定程度上约束全国人大的立法活动,但不能约束全国人大的宪法修改权。The power of the NPC Standing Committee to interpret the Constitution are specific,including three connotations.First,the NPC Standing Committee interprets the Constitution specifically.The power of“interpreting the Constitution”stipulated in Article 67,Item 1 of the Constitution does not necessarily depend on or include the power of“supervising the implementation of the Constitution”stipulated in the same item.It cannot be replaced by other powers in terms of its nature and function.In addition to constitutional supervision,the NPC Standing Committee still has the institutional space to simply exercise the power of constitutional interpretation.Second,the effect of the NPC Standing Committee's interpretation of the Constitution is certain.The National People's Congress can supervise the NPC Standing Committee to exercise its power of constitutional interpretation,but in order to maintain the certainty of constitutional interpretation,the National People's Congress should respect the authority of the NPC Standing Committee in constitutional interpretation.Third,the interpretation of the Constitution made by the NPC Standing Committee also has certain binding force on the National People's Congress,which can restrict the legislative activities of the National People's Congress to a certain extent,but cannot restrict the right of the National People's Congress to amend the Constitution.
