摘　　要：行政处罚机关转送行政复议申请制度,是以推动行政纠纷实质性化解为制度目标导向,针对特定类型行政处罚决定建立的行政复议申请便利机制。立足行政先行自纠及充分激发行政程序的纠纷吸纳化解功能,行政复议申请转送制度将行政执法反思评估机制内嵌于行政复议申请转送程序之中,是融贯行政复议便民为民属性与行政先行自纠属性、集行政复议程序回应与被处罚人实体请求处理功能于一体的综合性制度。行政复议申请转送制度运行需防范程序天窗、制度价值贬损、行政复议救济不畅等结构性问题。行政复议申请转送制度需以行政执法反思评估与行政复议申请处理为规范重点加以配套完善。The system of administrative penalty organs transferring applications for administrative reconsideration is established as a convenient mechanism for submitting administrative reconsideration applications in response to specific types of administrative penalty decisions,aiming to promote the substantive resolution of administrative disputes.By focusing on administrative self-correction and fully leveraging the dispute absorption and resolution capabilities of administrative procedures,this system of administrative reconsideration application transfer incorporates a reflection and evaluation mechanism for administrative law enforcement within its process.It is a comprehensive system that combines the convenience-oriented attributes of administrative reconsideration with the inherent principles of administrative self-correction,encompassing both response to the administrative reconsideration procedure and handling of the substantive requests made by the penalized individual.The implementation of the administrative reconsideration application transfer system requires vigilance against structural problems such as procedural gaps,diminution of institutional value,and obstacles in administrative reconsideration remedies.The administrative reconsideration application transfer system should give priority to administrative law enforcement reflection and evaluation,as well as the handling of administrative reconsideration applications,which should be supported and improved accordingly.
