摘　　要：秦汉简牍法律文献中所见“毋害”一词,是对官吏的评价用语。“害”为“造成危害”,“毋害”作为评价官员品性的用词,是由“没有瑕疵”引申而来的“严谨、认真”之义,强调官员提拔、任用的个人品行,将其作为察举官吏的标准之一。在秦汉律令文献中,“毋害”与“不害”在表达危害程度上有所差别。“毋害”强调从未发生具有危害性的事情;“不害”强调已经发生的事情不具有严重危害性,即危害程度较轻。The term"Wu Hai(毋害)"is found in the legal documents of the Qin and Han bamboo slips,and is a lerm of evaluation of officials,For"Hai(害)"read"cause harm","Wu Hai(毋害)"as a word used to assess the character of an official,it is the mearing of"rigorous and conscientious"derived from"without blemish",emphasizing the personal conduct of officials lor promotion and appointment as one of the criteria for selecting officials,In the literature of Qin and Han dynasties,there is a difference bet ween"Wu Hai(毋害)"and"Wu Hai(不害)"in expressing the degrec of harm."Wu Hai(毋害)"cmphasizes that nothing harmful has ever happened;"Wu Hai(毋害)"emphasizes that what has happenelis not seriously harmful,the degree of harin is less.
