社会治理视角下新时代社会保障法律制度建设

摘　　要：中国特色社会主义进入新时代,人工智能的高速发展与生产方式的变革以及人口结构的变化等,将对现行社会保障制度安排带来一定挑战。我国依赖政治承诺和制度创新建成了世界最大的社会保障体系,今后需要嵌入“社会治理”,在政府和市场之间创造社会对话与共同决策的空间,形成利益相关人依法合作机制,健全社会保障法治,实现共建共享共赢。为此,在学习贯彻党的二十届三中全会《决定》的基础上,从充分就业、公平分配、医疗保障、养老保险、社会保障体系建设和社会保障公共服务六个维度,嵌入社会治理和建设社会保障法治具有现实必要性,能进一步促进我国社会保障体系的可持续发展。As the socialism with Chinese characteristics enters a new era,the rapid development of artificial intelligence,the transformation of production mode and the change of population structure will bring certain challenges to the current social security system arrangement.Our country has built the world's largest social security system through political commitment and institutional innovation.In the future,we need to embed"social governance"to create a space for social dialogue and joint decision-making between the government and the market,establish a legal mechanism for cooperation among stakeholders,and improve the social security legal system,and achieve the joint construction,sharing and win-win results.Therefore,on the basis of studying and implementing the resolution of the Third Plenary Session of the 20th Central Committee of the Communist Party of China,and viewing from the six dimensions of full employment,fair distribution,medical security,pension insurance,social security system construction and social security public service,there is the practical necessity to embed the social security legal system in social governance and build the social security rule of law,which can further promote the sustainable development of China's social security system.
