摘　　要：在进一步深化社会保障体制改革的进程中,社会保障法的协同性需要引起关注。社会保障法的协同性有形式协同性和实质协同性两重内涵。从法律实施情况来看,形式协同性既表现为社会保障法与财税法、金融法、慈善法等存在的法间协同需求,也表现为社会保障法的实施需要多部门共同协作的部门协同需求。长期以来,学术界主要围绕生存权保障来界定社会保障法的实质协同性,这已经落后于时代要求。实质协同性更为准确的表达应为生存权兜底与发展权促进之间的协同。新型社会保障制度的构建进一步丰富了社会保障法实质协同性的具体内涵。建构社会保障法的协同性,首先要处理好社会保障立法中“促进”与“限禁”的选择问题,明晰社会保障法形式协同性与实质协同性的法律基础;其次,要深化《社会保障法典》立法进程与实质协同性的交互关系;最后,要明晰形式协同性在三次分配中的不同体现,重点关注共享理念指导下的协同路径。In the course of further deepening the reform of the social security system,the synergy of the social security law needs to be given attention.The synergy of the social security law has two connotations:formal synergy and substantive synergy.From the perspective of legal implementation,formal synergy is manifested not only in the need for inter-branch coordination with tax law,financial law,charity law,and other legal domains,but also in the need for multi-departmental coordination during the legal implementation process.For a long time,the academic community has mainly defined the substantive synergy of social security law around the protection of the right to survival,which has fallen behind the requirements of the times.A more accurate expression of this synergy should be the coordination between the safety net for the right to survival and the promotion of the right to development.The construction of a new social security system is constantly enriching the specific connotations of the substantive synergy of social security law.To further construct the synergy of social security law,the first step is to address the choice between"promotion"and"restriction"in social security legislation,and clarify the legal foundations of both formal and substantive synergy of social security law;Secondly,we need to deepen the interaction between the legislative process and substantive synergy of the Social Security Code;Finally,we must clarify the different manifestations of formal synergy in the three-tiered system of distribution,with a particular focus on the coordinated path guided by the philosophy of shared prosperity.
