摘　　要：作为国家发展的战略性资源,知识产权在全球范围的运行逻辑已经完成了从“市场特权、私权”到“国家安全与创新发展权”的演化。知识产权安全实现了创新发展权视阈中的安全治理体系重构。保障创新发展权,旨在不受其他国家政策手段限制,拥有独立自主实施创新发展的国家能力,享有市场创新的激励、实现自主创新的保障、促进创新的安全与开放。对此,亟待建立由知识产权法律制度、知识产权监测预警和风险防控体系以及保障性政策组成的国家知识产权安全体系,加强事关国家安全的关键核心技术自主研发和保护,妥善预警监测各类涉外知识产权风险,制定与国情发展阶段匹配的知识产权域外适用规则及可能的反制手段,继而形成保障创新发展权、促进新质生产力提升的现代治理机制,实现重点产业健康、稳定、可持续发展。This article explains the evolution logic of intellectual property security and clarifies the construction of a national intellectual property security governance system from the perspective of the right to innovation and development,as well as its inherent connection with comprehensive innovation.Based on international experience,it is proposed to establish an intellectual property security governance system that goes beyond“market and private rights”,and emphasizes“government and innovation development rights”.The system is composed of intellectual property legal system,intellectual property risk prevention,and intellectual property protection policies.Ensuring the right to innovative development,establishing a security governance system for intellectual property,strengthening independent research and development and protection of key core technologies related to national security,properly warning and monitoring various foreign-related intellectual property risks,formulating rules for the extraterritorial application of intellectual property that match the national development stage,and forming legitimate and effective countermeasures,enhancing the overall competitiveness of industrial intellectual property and its ability to resist shocks and threats,will help promote high-quality transformation and development.
