《中华人民共和国档案法实施条例》的功能定位、缺憾检视与优化路径

摘　　要：《中华人民共和国档案法实施条例》是国务院为执行档案法律规定而制定的行政法规,其功能在于解释和细化档案法律文本,补充档案法律规定中的未尽事宜。《中华人民共和国档案法实施条例》为档案事业创新发展提供了强有力的法治保障,但依然存在档案开放审核标准不清、档案违法行为列举不全、档案行政处罚监督缺位等问题,阻碍着条例实然功能的发挥。对此,应当立足档案工作现状,坚持体系化思维,有针对性地纾困解难。一是建立规范化的档案开放审核机制,防止审核者滥用自由裁量权;二是增设档案违法行为的概括性规定,弥补列举性规定的固有不足;三是引入档案行政处罚检察监督制度,补强优化档案行政处罚监督体系。Regulations for the Implementation of the Archives Law of the People's Republic of China are administrative regulations formulated by the State Council for the implementation of the legal provisions on archives,whose functions include interpreting and refining the text of the archives law,and supplementing the unfinished matters in the provisions of the archives law.Regulations for the Implementation of the Archives Law of the People's Republic of China provide a strong rule of law guarantee for the innovative development of the archives cause,but there are still problems such as unclear auditing standards for the opening of archives,incomplete enumeration of archives violations,and lack of supervision of archives administrative penalties,which impede the play of the actual function of the regulations.In this regard,should be based on the current situation of archives,adhere to the systematic thinking,targeted relief.First,the establishment of a standardized archives open audit mechanism to prevent the auditor from abusing his discretionary power;second,the addition of general provisions on archives violations to make up for the inherent deficiencies of enumerated provisions;third,the introduction of the archives administrative penalty inspection and supervision system to strengthen and optimize the supervision system of archives administrative penalties.
