档案行政执法权的乡镇配置--以《中华人民共和国档案法实施条例》相关规定为分析背景

摘　　要：《中华人民共和国档案法实施条例》要求乡镇建立保障档案行政执法权正当行使的档案工作规范,但现实中的乡镇政府基本不拥有档案行政执法权,这导致乡镇政府面临权责失衡,不得已采取变通式做法以及档案治理协同机制难以形成的困局。档案违法行为在短时间内就可以造成利益受损的重大风险和严重后果,因此迫切需要将档案行政执法权配置给乡镇政府以缓解执法压力,而乡镇政府事实上也具备档案行政执法权的承接能力。档案行政执法权的乡镇配置需要遵循权责对称的基本要求,并达到效能最优的实质目标。在具体配置时需要将信息获取类与轻微制裁类档案执法权配置给乡镇政府,并在短期内采取委托或者间接授权的方式进行,但长期赋权必须对法律条文进行修订,此外,综合执法队伍与档案管理部门的联合执法可以作为乡镇档案行政执法权的运行保障。Regulations on the Implementation of the Archives Law of the People's Republic of China require townships to establish archival work norms that safeguard the proper exercise of archival administrative law enforcement powers,but the reality is that township governments basically do not possess archival administrative law enforcement powers,which has led to a dilemma in which they face an imbalance of powers and responsibilities,have no choice but to adopt alternative practices,and find it difficult to form a synergistic mechanism for archival governance.Archival violations can result in significant risks of damage to interests and serious consequences in a short period of time,so there is an urgent need to allocate archival administrative law enforcement powers to township governments to alleviate the pressure of law enforcement,and the township governments do in fact have the capacity to take over archival administrative law enforcement powers.The township configuration of archives administrative law enforcement power needs to follow the basic requirements of symmetry of power and responsibility and achieve the substantive goal of optimal efficiency.In the specific configuration of the need to access to information and minor sanctions category archives law enforcement rights allocated to the township government,and in the short term to take entrusted or indirect authorization,but long-term empowerment must be revised legal provisions,in addition to the comprehensive law enforcement team and archives management department of the joint law enforcement can be used as the township archives administrative law enforcement rights of the operation of the security.
