摘　　要：司法实践和学界研究均未对国家档案馆档案利用服务的行为性质形成统一认识,既不利于局馆分立后二者的法定职责划定,也不利于档案利用权利请求得到有效处理。本文从实证法层面出发,发现在国家档案馆档案利用诉讼案件中,行政诉讼案由识别较混乱,国家档案馆诉讼主体资格认定存在偏差,客观上限缩档案利用权利救济的途径。根据资格要件、权力要件、法律要件和形式要件,本文界定了国家档案馆档案利用服务在行政法上的行为性质及可诉性。为保障档案利用服务规范高效推进,应明晰档案机构的职责定位,规范运作多元化权利救济机制,协同强化国家档案馆信息服务能力。Judicial practice and academic research have not formed a unified understanding of the legal nature of the national archives'archival utilization service,which is not conducive to the delineation of the legal duties after the separation of the bureau and the archives,nor to the effective processing of requests for the access to utilize archives.From the level of empirical law,it is found that in the litigation cases of the national archives'archival utilization,the identification of administrative litigation causes is confusing,the qualification of the litigation subject of the national archives is biased,and the access to remedies for archive users is objectively limited.According to the qualification element,power element,legal element and form element,the behavioral nature and the justiciability of the national archives'archival utilization service in the administrative law are defined.In order to ensure the standardization and efficient promotion of archival utilization service,the responsibilities and position of archival institutions should be clarified,the operation of a diversified rights relief mechanism should be standardized,and the information service capacity of the national archives should be deepened in a coordinated manner.
