摘　　要：《民事强制执行法(草案)》对未成年子女抚养权强制执行制度的构建进行了初步探索,但由于该草案意见分歧较大已终止审议,致使该制度在立法层面未能得以确立。未成年子女抚养权强制执行制度的构建既有必要性,也有可行性,在对该制度进行构建时应注意两个方面:一是对未成年子女抚养权的强制执行既可以采取间接强制,也可以采取直接强制,在顺位上应优先适用间接强制;二是如果存在未成年子女明确表示反对、强制执行会严重侵害未成年子女权益,以及判决自生效后满一定期限未及时履行等事由,可以产生阻却强制执行的效果。The Draft Law on Civil Enforcement conducted a preliminary exploration of the construction of a system for enforcing the right to custody of minor children,but due to the wide divergence of opinions on the draft the deliberations of the draft have been terminated,resulting in the system not being established at the legislative level.The study concluded that it was both necessary and feasible to establish a system for enforcing the right to support minor children.In the specific construction of the minor child support right enforcement system,should pay attention to the following two aspects:First,the enforcement of the minor child support right can be taken either indirectly or directly,in order to give priority to the application of indirect coercion;Second,if there is a minor child explicitly expresses his or her opposition to the enforcement of the rights and interests of the minor child will be seriously infringed upon,as well as the judgment has been a certain period of time after the entry into force of the judgment has not been fulfilled,etc.,the court shall not be able to take any action against the minor child.Secondly,if there is a minor child expressly opposes,enforcement will seriously infringe the rights and interests of the minor child,and the judgment after the entry into force of a certain period of time has not been fulfilled,etc.,can produce the effect of blocking enforcement.
