道路交通事故责任立法演变与执法应用研究

摘　　要：道路交通事故责任是我国道路交通事故理论研究及执法实务关注的核心与重点,但一些基本理论认识和观点还不够深入,同时也是执法实务中的难题。从道路交通事故处理新旧立法对比分析的视角,对道路交通事故责任进行全方位深入研究。对道路交通事故责任的性质、主体、过错、因果关系、限定条件和定量条件等要素所涉及的一些基本认识、观点进行反思,针对这些内容分别得到了一些新的认识。在此基础上,对应提出解决执法实务相应难题的具体思路。Road traffic accident liability is the core and focus of the road traffic accident theory research and law enforcement practice in China.But some of the fundamental theories and viewpoints are not deep enough,and it is also a difficult problem in law enforcement practice.From the comparative analysis perspective of the new and existing legislation on road traffic accident handling,the road traffic accident liability is studied on all aspects.In this study,some basic understandings and viewpoints of the road traffic accident liability are reflected,such as the nature,the subject,the fault,the cause-and-effect relation,the qualification and the quantitative condition.And some new ideas on these aspects are obtained.Based on the reflection and the new viewpoints,the specific solutions are put forward to solve the corresponding problems in law enforcement practices.
