电商平台“二选一”限定交易的法律规制探析

摘　　要：电商平台作为电子商务的枢纽天然具有市场优势或支配地位,一些电商平台实施“二选一”限定交易本质上是滥用优势排斥对手的不正当竞争行为。现行法律规制存在着预防性不足、衔接度不够和操作性不强等诸多问题,须在定性量化、领域归类、处罚标准等方面进行优化,实现对“二选一”限定交易违法行为的全方位、全过程规制,确保电商市场的健康发展。As the hub of e-commerce,e-commerce platforms naturally have market advantages or dominant positions.Some e-commerce platforms implement a“Choose One from Two”restriction on transactions,which is essentially an unfair competition behavior that abuses their advantages to exclude competitors.There are many problems in the current legal regulations,such as insufficient prevention,inadequate connection,and weak operability.It is necessary to optimize the qualitative and quantitative aspects,field classification,and punishment standards to achieve comprehensive and full process regulation of illegal activities in the“Choosing One from Two”restricted transactions,ensuring the healthy development of the e-commerce market.
