村规民约备案审查机制完善研究

摘　　要：村规民约备案审查是中国特色备案审查制度体系的重要组成部分。通过考察实践场域中村规民约备案审查的机制运行,探查村规民约的质性与类型并解析村规民约备案审查过程与构成要素。村规民约备案审查机制在主体层面、程序层面、标准层面存在着建构性困境,集中体现为权能受限下的主体失格、制度留白下的程序失范、规范张力下的标准失当。基于村规民约的规范特性,需要在主体层面形成以乡镇政府为主导的多元主体协作审查格局,在程序层面细化村规民约的报备与受理程序、完善村规民约审查与审查报告出具程序、强化审查未通过的村规民约责令改正程序,在标准层面构设村规民约备案审查所应依循的合法性、合理性、规范性标准体系,从而系统完善村规民约备案审查机制。The filing and review of village regulations is an important part of the filing and review system with Chinese characteristics.By investigating the operation of the filing and review mechanism of village regu‐lations in the practice field,the paper explores the nature and types of village regulations and analyzes the pro‐cess and constituent elements of the filing and review of village regulations.There are constructive dilemmas in the filing and review mechanism of village regulations at the subject level,procedural level and standard level,which is mainly reflected in the subject’s disqualification under the limitation of power,the procedural miscon‐duct under the institutional voids,and the inappropriate standards under normative tension.Based on the norma‐tive characteristics of village regulations,at the subject level,it is necessary to form a multi-subject collabora‐tive review pattern led by township governments.At the procedural level,it is necessary to refine the reporting and acceptance procedures of village regulations,improve the procedures for reviewing and issuing reports on village regulations,and strengthen the procedures for ordering corrective actions for village regulations that have not been approved.At the standard level,it is necessary to establish a legal,reasonable and normative stan‐dard system that should be followed for the filing and review of village regulations,in order to systematically improve the filing and review mechanism of village regulations.
