摘　　要：公共数据信托是公共数据资产管理与公共数据治理的新兴模式,是我国公共数据有偿授权运营的创新实践探索。公共数据委托方以所持有公共数据的部分或全部权利与权益设立信托,依托信托的法律功能与金融功能破解公共数据有偿授权运营中的数据确权、交易信任与利益分配等问题,实现公共数据安全与增值性开发利用双重目标,促进公共数据由资源化到资产化再到资本化的价值生成。对中国式公共数据信托化有偿授权运营模式的深入探究既是对当前公共数据运营、数字治理、数字中国、数据财政建设等重大热点理论问题的回应,也为当下公共数据授权运营试点开展公共数据信托实践探索提供参考和指引,推动实现以公共数据运营引领数据要素市场化培育,释放公共数据价值,赋能数字政府建设、数字治理与数字经济发展。Public data trust is an emerging model of public data asset management and public data governance,and is an innovative practical exploration of paid authorized operation of public data in China.The entrusted party of public data establishes a trust with part or all of the rights and interests of the public data held by it,relying on the legal and financial functions of the trust to solve the problems of data rights,transaction trust and benefit distribution in the operation of paid authorization of public data,to achieve the dual objectives of security and value-added exploitation of public data,and to promote the generation of value of public data from resources to assets and then to capitalization.The in-depth exploration of the Chinese-style public data fiduciary paid authorized operation model is not only a response to the current public data operation,digital governance,digital China,data financial construction and other major hot theoretical issues,but also provides reference and guidance for the current public data authorized operation pilot to carry out public data fiduciary practice exploration.It will also promote the realization of public data operation to lead the market cultivation of data elements,release the value of public data,and empower the construction of digital government,digital governance and digital economy.
