摘　　要：“软法柔治”,挖掘新时代软法所蕴含的柔性治理力量是构建基层体育治理新秩序的应然逻辑。软法特征主要表现为创制过程中的主体多元化与治理过程中手段柔性化。基于宏观规划、中观增益与微观填补三个维度,软法在基层体育治理中发挥着降低实际成本损耗、提供新的逻辑生长点以及为硬法规则拾遗补缺的重要作用。当前,基层体育治理中的“软法柔治”存在诸多不敷适用之处,以程序旁落、规则之争与效力式微为代表的软法治理困境桎梏了基层体育治理法治化的进程。为此,需要进一步厘清软法与硬法适用的界限范围,探析软法柔治的运行机理和作用机制。从“程序兼容”“新旧兼顾”“软硬兼施”三个方面推进新时代基层体育的软法之治。"Soft law and soft governance"excavating the soft governance power contained in the soft law in the new era is the necessary logic to build a new order of grassroots sports governance.The characteristics of soft law are mainly manifested in the pluralism of subjects in the process of creation and the flexibility of means in the process of governance.Based on the three dimensions of macro planning,medium gain,and micro filling,soft law is essential in reducing the actual cost loss,providing new logical growth points,and compensating for the complex laws and regulations in grassroots sports governance.At present,the"soft law and soft governance"in grassroots sports governance has many shortcomings,and the predicament of soft law governance represented by procedure omission,rule dispute and weak effectiveness has shackled the process of legalization of grassroots sports governance.Therefore,it is necessary to further clarify the applicable limits of soft law and hard law,and explore the operating mechanism and action mechanism of soft law and soft law.The three aspects of"procedure compatibility,""new and old"and"both soft and hard"to promote the soft law governance of grass-roots sports in the new era.
