党的领导入法的政治性判断标准及其适用

摘　　要：党的领导入法是中国特色社会主义法治建设的一个显著特征,也是着力实现党的领导制度化、法治化的客观要求。从百余年的制度演进历程看,党的领导入法在革命时期初显、在社会主义建设和改革中不断调适、在新时代实现系统集成,政治性因素构成其发展演进的内在动因。政治性塑造了党的领导入法的范围,就党的领导入法的政治性判断标准而言,其以全局性要素、复杂性要素为强政治性构成要件,以非权力性要素、专业性要素为弱政治性构成要件。基于类型化思维,通过运用政治性判断标准对不同法律的政治性强弱程度进行甄别,可以厘定党的领导入法的三种范围类型,即强政治性范围、较强政治性范围、弱政治性范围。在此基础上,根据每一类党的领导入法范围的不同特性建构相应的审查基准,即强政治性范围的必需基准、较强政治性范围的选择基准、弱政治性范围的谦抑基准,有助于推进党的领导入法实践的精细化发展。The Party's leadership into the law is not only the prominent characteristic of the Chinese party's rule of law model,but also the objective requirement of the Party's leadership institutionalization and the rule of law.According to the evolution of this system for more than 100 years,the practice of the Party's leadership into law was initially evident in the revolutionary period,adjusted in the socialist construction and reform period,system-integrated in the new era,and political factors constitute the internal motivation of its development and evolution.The standard logic of the political shaping of the party's leadership into the scope of the law takes the overall elements and complexity elements as the strong political constituent elements,and the non-power elements and professional elements as the weak political constituent elements.By using typological thinking and judging national laws according to the political intensity standard,three scope types of Party's leadership into law can be determined,namely,strong political scope,fairly strong political scope and weak political scope.On this basis,according to the different characteristics of each type of entry into the law,the corresponding review criteria are constructed,namely,the"mandatory"criteria of the strong political scope,the"selective"criteria of the fairly strong political scope,and the"modest"criteria of the weak political scope,which is conducive to refining the practice of the Party's leadership into the law.
