以道路交通执法为例的自动化行政行为法律规制

摘　　要：随着新一代信息技术的发展,我国数字政府建设已然迈入快车道。道路交通管理领域的自动化行政执法具有非接触性、高效性、全天候性等优势。然而,目前自动化行政执法行为的法律规制有待完善。文章以道路交通管理领域的自动化行政执法行为为例,针对所存在的电子监控设备的设置和维护、法律程序的瑕疵、持续状态的违法行为的认定、难以合理行使裁量权导致过罚不当等问题,从进一步规范自动化执法设备的设置和维护,完善正当法律程序等方面提出了对策建议。With the advancement of new-generation information technology,China's digital government construction has entered the fast lane.Automated administrative law enforcement in traffic management has merits such as non-contact,highefficiency and 24/7.However,the legal regulation in this field needs to be improved.Against this backdrop,taking the automation of administrative law enforcement in traffic management as an example,this thesis proposes suggestions in terms of further standardizing the maintenance and setup of law enforcement equipment,improving due legal procedures to address the issues such as difficulties in the setup and maintenance of law enforcement equipment,the defects in legal procedures,the determining of continuous state violations,and the difficult exercise of discretionary power leading to improper penalties.
