职业歧视与行业应对:民初徐碧云诈骗案探析

摘　　要：民初北京发生一起极为平常的诈骗案,但因徐碧云名伶身份,引发了社会的口诛笔伐,不仅极大损害伶人形象,而且进一步引发律师等对伶人的职业歧视。京师地方检察厅依法轻判,但远在上海的王开疆律师因案犯的伶人身份主张严惩,其带有歧视的言论进一步贬损了伶人形象与名誉,遭到上海伶界联合会严词驳斥,要求其作出合理解释。王开疆“当然尊重贵会诸君”之表达,又引起上海律师界的不满,认为向“低贱”伶人表示尊重与道歉,便是自我贬损。徐碧云案引发民初伶人歧视、职业贵贱等问题,透视出民初提倡社会平等与现实的严重背离。上海伶界联合会等在捍卫伶人职业形象与职业平等中扮演了重要角色。In the early years of the Republic of China,a common case of fraud occurred in Beijing,which caused a great deal of public criticism because of Xu Biyun’s status as a famous actor.The District Public Prosecutors Office was given a light sentence in accordance with the law,but the shanghai-based lawyer,Wang Kaijiang,demanded severe punishment because of his status as an actor.His discriminatory remarks further tarnished the image and reputation of the actors,and were severely refuted by the Shanghai Artists’Guild,ask for a reasonable explanation.Wang Kaijiang’s expression of“Of course respect for the members of the Royal Society”also aroused the dissatisfaction of the Shanghai lawyers.The case of Xu Biyun leads to the problems of discrimination against actors in the early years of the Republic of China,such as the high and low occupation,etc..The Shanghai Federation of opera Singers has played an important role in safeguarding the professional image and professional equality of opera singers.
