摘　　要：如何在行政执法过程中依法厘清合法委托加工还是违法生产农药行为,成为当前亟待明确的问题。本文根据《行政处罚法》《农药管理条例》之规定,结合《民法典》委托合同相关内容,讨论分析了农药委托加工合规的构成要件,对非法农药委托加工的认定提出相应的标准,期待明确具体行政执法行为,引导广大农药生产企业合法委托加工,构筑规范的市场秩序。In the process of administrative law enforcement,distinguishing between the legal commissioned processing and illegal production of pesticides has become an urgent issue.This paper discussed and analyzed the compliance elements of pesticide commissioned processing in light of the provisions of the Administrative Penalty Law of the People’s Republic of China and the Regulations on Pesticide Management,along with the relevant provisions of the Civil Code regarding commission contract.It proposed corresponding standards for the identification of illegal pesticide commissioned processing,aiming to clarify specific administrative law enforcement actions and guide pesticide production enterprises in legally commissioning processing and to establish a standardized market order.
