省级学位委员会的法律定位及其权力规制研究

摘　　要：在新《学位法》实施背景下,省级学位委员会被赋予领导本地区学位工作的行政主体资格。从现实基础看,政策文件授权模式下的省级学位委员会职权并不明确,权力行使过程中也面临不当干预高校办学自主权、学位统筹调控权异化和监督指导权虚置等问题,构成省级学位委员会法定化的实践动因。从规范定位看,省级学位委员会的设立与职权行使长期依赖政策文件的授权,很大程度上影响了职权行使的规范性。《学位法》在明确“行政主体”逻辑下完善省级学位委员会职责权限和权力运行规则。具体而言,应在《学位法》配套制度中系统规定省级学位委员会职责权限、权力运行的实体和程序内容,确保学位管理体制有序运行。In the context of the implementation of the new Academic Degrees Law,the provincial academic degree committees have been given the qualification of administrative subjects to lead the work of academic degrees in their own regions.From the perspective of reality,the authority of provincial degree committees under the authorization of policy documents is not stable and clear,and in the process of exercising the authority,they face the problems of undue interference in the autonomy of colleges and universities in running schools,alienation of the authority to coordinate and regulate the degrees,and virtual placement of the authority to supervise and direct,etc.These problems constitute the practical motives for the legalization of the provincial degree committees.From the point of view of normative orientation,the establishment of provincial degree committees and the exercise of their powers have long relied on the authorization of policy documents,which to a large extent affects the normativity of the exercise of their powers.The Academic Degrees Law improves the duties and powers of the provincial degree committees and the operation rules of the powers under the logic of clarifying the“administrative subject”.Specifically,the supporting system of the Academic Degrees Law should systematically stipulate the substantive and procedural contents of the duties and powers of the provincial degree committees,so as to ensure the orderly operation of the degree management system.
