应对法律战视角下的涉外法治建设初探

摘　　要：近年来,霸权国家以“维护国家安全”为由对外恣意实施法律战的倾向日益明显,以法律战为代表的“软战争”已逐渐成为服务霸权和强权政治的新策略。当前,中国进入战略机遇和风险挑战并存、不确定难预料因素增多的新发展阶段,来自外部势力的打压遏制不断升级,被迫卷入法律战风险日益加大,在此背景下如何贯彻习近平法治思想,大力加强涉外法治建设,有效破解法律战,成为推进中国式现代化建设进程中亟待回应的问题。中国也着手从推进涉外法治建设入手,积极维护国家主权、安全、发展利益。本文旨在以习近平法治思想为指导,思考加强涉外法治建设和增强涉外法律斗争能力的意义和必要性,探索有理、有利、有节应对和破解外部势力涉华法律战的路径和方式。In recent years,hegemonic countries have shown an increasingly obvious tendency to wantonly carry out international legal wars on the grounds of“safeguarding national security”,and the“soft war”represented by legal wars has gradually become a new strategy to serve hegemony and power politics.At present,China has entered a new stage of development,in which strategic opportunities,risks and challenges coexist,and uncertainties and unpredictable factors are on the rise.With the escalation of repression and containment from external forces,the risk of China being forced into legal wars is increasing.In this context,how to implement Xi Jinping’s thought on the rule of law,vigorously strengthen the construction of China’s legal capabilities concerning foreign aff airs,and eff ectively crack the legal war has become an urgent issue to be addressed in the process of promoting the Chinese-style modernization.This paper,taking Xi Jinping’s thought on the rule of law as guidance,aims to think about off ensive and defensive strategies relating international legal struggle,and explore ways and means to respond to and crack legal wars launched on China by external forces on just grounds,to our advantage and with restraint.
