执法权下放背景下乡镇政府的整合功能及其法治实现

摘　　要：2021年《行政处罚法》新增第24条,推动行政处罚权下放到乡镇,这标志着乡镇政府行使执法权得到了法律的明确授权。作为国家政权体系末梢的乡镇政府承担着整合基层社会的重任,而执法权下放是逐步破除阻碍乡镇政府发挥整合功能制度障碍的重要举措。乡镇政府发挥整合功能需要从价值整合、利益整合与社会秩序整合三个维度进行,这需要破除乡镇政府执法权配置不合理的体制障碍。因此应当通过推进乡镇政府制度化建设、优化乡镇政府权力配置以及加强乡镇执法资源供给等方式回应现实问题,增强乡镇政府的整合能力,推动基层治理能力的提升。Article 24 of the 2021 Administrative Punishment Law was added to promote the decentralisation of administrative penalties to townships,marking the clear authorisation of the exercise of law enforcement powers by townships under the Administrative Acts Law.As the end of the state power system,the township government needs to undertake the important task of integrating the grassroots society,and the decentralisation of law enforcement power is an important measure to gradually break down the systemic obstacles that hinder the township government from playing its integration function.The integration function of the township government needs to be carried out in the three dimensions of value integration,interest integration and social order integration,which needs to break down the institutional obstacles of insufficient institutionalisation level of the township government,irrational allocation of law enforcement power and insufficient law enforcement resources.Therefore,it is necessary to respond to the real problems by promoting the institutionalisation of township governments,optimising the allocation of township government powers and strengthening the supply of law enforcement resources in townships,so as to enhance the integration capacity of township governments and promote the enhancement of grassroots governance capacity.
