论中国式现代化背景下农村妇女土地权益保护的立法路径

摘　　要：在农村土地二轮承包即将到期之际,回溯农村土地法律制度实施的过程,较为突出的问题是农村妇女土地权益受损害。对此应调整家庭成员增减承包地的法律条件,制定分户承包地分割登记制度,建立农村土地用益物权共有制度,完善农村妇女土地权益救济制度,加强农村土地妇女权益保护,为推进共同富裕、实现农业农村的中国式现代化打下良好的法治基础。When the second contract is about to expire,looking back on the implementation of the rural land legal system,the problem of rural women’s land rights and interests being damaged is more prominent.In this regard,we should stipulate the legal conditions for the adjustment of contracted land due to the increase or decrease of family members,establish the registration system of contracted land when households are divided,establish the system of common ownership of rural land usufruct,improve the relief system for rural women’s land rights and interests,and strengthen the protection of rural land women’s rights and interests,so as to lay a good foundation for the rule of law to promote common prosperity and realize Chinese modernization of agricultural and rural areas.
