摘　　要：分析了数字农业中数据隐私保护和知识产权保护的现状与挑战。首先,数字化转型过程中,农业企业面临数据滥用和数据泄露风险,现有法律虽然提供了一定的保护措施,但仍需进一步完善。其次,数字农业技术创新离不开知识产权保护,法律应明确技术转让、合作开发和利益分配等问题。最后,合同与责任问题是数字农业中不可忽视的法律议题,应通过详细合同条款和完善合同管理机制来保障各方权益。为促进数字农业的健康发展,该研究提出了完善法律法规、建立综合性法律体系、加强跨部门合作与监督机制等对策。This paper analyzes the current state and challenges of data privacy protection and intellectual property protection within digital agriculture.Firstly,during the digital transformation,agricultural enterprises face risks of data misuse and data breaches;existing laws offer some protection but require enhancement.Secondly,innovation in digital agriculture technology necessitates robust intellectual property protection,with legal frameworks needing to clarify issues such as technology transfer,cooperative development,and benefit distribution.Moreover,contract and liability considerations are critical in digital agriculture,necessitating detailed contract terms and effective management mechanisms to safeguard the rights of all parties.To foster the healthy development of digital agriculture,this paper recommends improving laws and regulations,establishing a comprehensive legal system,and enhancing cross-departmental cooperation and supervision mechanisms.
