摘　　要：国际航空碳抵消与减排机制(CORSIA)旨在通过市场机制实现航空业的碳减排,由于在航空产业、能源结构和环境政策等方面的差异,各国对该机制持有不同观点,造成分歧的根源是不同国家在平衡气候治理和航空业发展上的抉择不同。对中国而言,CORSIA的公平性存在严重缺陷,这将严重阻碍航空强国发展战略的推进,亟须通过立法予以应对。在立法逻辑上,中国应以实现气候正义为基本理念,统筹国际规则与国内规则,并通过“走出去”与“引进来”的系统论方法构建与CORSIA相关的涉外法律体系。在立法路径上,中国应对CORSIA的制度建构应循序渐进展开。短期应聚焦航空业内部的碳排放制度探索;中期应注重航空业碳排放管理与国家碳市场秩序之间的调适与协调;长期应实现气候治理、民航运输管理及涉外保障等法律制度内容的体系化。The Carbon Offsetting and Reduction Scheme for International Aviation(CORSIA)aims to achieve carbon emission reduction in the aviation industry through market mechanisms.However,due to dif-ferences in the aviation industry,energy mix,and environmental policies,different countries have taken vari-ous positions on this mechanism.This divergence stems from the varied choices every country adopts in bal-ancing climate governance and the development of the aviation industry.For China,the significant shortcom-ings in the fairness of CORSIA will severely hinder the development strategy of becoming a major aviation power,necessitating a legislative response.In terms of legislative logic,China should adopt climate justice as its basic concept,coordinate international and domestic rules,and establish a foreign-related legal system concerning CORSIA through a systematic approach of the“go global”and“bring in”strategies.Regarding the legislative path,China’s institutional construction in response to CORSIA should be carried out in a gradual way.In the short term,we ought to focus on exploring the carbon emission system within the aviation industry.In the medium term,emphasis should be placed on the adjustment and coordination between car-bon emission management in the aviation industry and the national carbon market order.The long-term ob-jective is to achieve the systematization of legal systems covering climate governance,civil aviation transpor-tation management,and foreign-related security.
