职务犯罪监检移送审查衔接机制研究——以《中华人民共和国监察法》第四十七条第三款为切入点

摘　　要：移送审查制度是职务犯罪从调查程序转向司法程序的关键节点,监检在移送审查程序中的衔接顺畅才能保证处理整个职务犯罪的顺利进行。《监察法》第四十七条第三款规定了检察机关退回补充调查和自行补充侦查制度,但规定不够明确,对于什么情况下检察机关可以退回补充调查,自行补充侦查何为必要以及具体如何运作都不甚具体。因此,在制度构建中应以人权保障作为基本理念,明确退回补充调查和自行补充侦查的适用条件,在标准问题上应以《刑事诉讼法》为准据,充分利用退回补充调查和自行补充侦查权来制约监察机关的职务犯罪调查活动。The transfer and review system is the key node of the transition from investigation procedure to judicial procedure in duty crimes.Only the smooth connection between supervision and inspection in transfer and review procedure can ensure the smooth progress of handling the whole duty crimes.The third paragraph of Article 47 of the Supervision Law stipulates that the procuratorial organ may return to the system of supplementary investigation and self-supplementary investigation,but the provisions are not sufficiently clear.It is not clear under what circumstances the procuratorial organ may return to the system of supplementary investigation,and it is not clear what is necessary and how to operate independent supplementary investigation.Therefore,in the process of building system must protect human rights as the basic idea to implement,clarify the applicable conditions for returning to supplementary investigation and self-supplementary investigation,the standard issue will be subject to the criminal procedure law,procuratorial organs should make good use of to return to supplement investigation and to supplement the indictment against the supervisory organ of duty crime investigation activities.
