黄河流域煤矿生态修复法律保障研究

摘　　要：黄河流域是我国重要的煤炭资源富集区,煤矿开发为黄河流域经济发展做出了重要贡献,但同时也带来了严重的生态环境问题。加强黄河流域煤矿生态修复法律保障,是贯彻“生态优先、绿色发展”理念,推动黄河流域高质量发展的迫切需要。本文在分析黄河流域煤矿开发现状及生态影响的基础上,对我国现有煤矿生态修复法律法规进行了归纳和梳理,指出了黄河流域煤矿开发法律保障方面存在的问题,并从健全法律法规体系、强化执法监管、创新投融资机制、加强全过程法律监督方面提出了完善黄河流域煤矿生态修复法律保障的对策建议,以期为推动黄河流域生态文明建设提供法治保障。The Yellow River Basin is an important coal resource rich area in China.Coal mining development has made significant contributions to the economic development of the basin,but at the same time,it has also brought serious ecological and environmental problems.Strengthening the legal protection of ecological restoration of coal mines in the Yellow River Basin is an urgent need to implement the concept of“ecological priority and green development”and promote high-quality development of the Yellow River Basin.Based on the analysis of the current situation and ecological impact of coal mine development in the Yellow River Basin,this paper summarizes and sorts out the existing laws and regulations on coal mine ecological restoration in China,points out the problems in the legal protection of coal mine development in the Yellow River Basin,and proposes countermeasures and suggestions to improve the legal protection of coal mine ecological restoration in the Yellow River Basin from the aspects of improving the legal and regulatory system,strengthening law enforcement supervision,innovating investment and financing mechanisms,and strengthening legal supervision throughout the process,in order to provide legal protection for promoting the construction of ecological civilization in the Yellow River Basin.
