摘　　要：老年意定监护制度的适用,意在实现尊重老年人“意思自治”与保护其“最佳利益”理念之间的平衡。医疗行为的风险性和高度人身性决定了在医疗权的行使过程中,意定监护人的代理行为需要根据医疗权的内容的不同而有所区别。鉴于医疗行为中意定监护人的代理权限较大,而作为被监护人的老年患者通常处于弱势地位,立法有必要进一步细化意定监护的适用规则。其中完善意定监护人的选任和意定监护制度的监督体系、承认并实现生前预嘱制度的合法化将为问题的解决提供思路。The application of the system of voluntary guardianship for the elderly is intended to strike a balance between respecting the“autonomy of will”of the elderly and protecting of their“best interests”.The risky and highly personal nature of medical treatment determines that the responsibility of the guardian should to be differentiated according to the contents of medical rights in this area.Considering that guardians often have substantial authority while the elderly patients they represent typically occupy a vulnerable position,legislation must further refine the applicable rules of voluntary guardianship.This includes improving the selection process for voluntary guardians and establishing a supervisory framework for the guardianship system,as well as legalizing and implementing living wills,which will offer solutions to these issues.
