涉网知识产权侵权纠纷案件管辖问题研究

摘　　要：网络知识产权侵权纠纷案件管辖确定存在诸多不确定因素,导致网络知识产权侵权纠纷案件管辖问题日益复杂化。应当清晰认识到案件的管辖是确保具体案件能否司法公正、高效和有序运作的关键因素,且对维护法律秩序和当事人的合法权益至关重要。针对网络知识产权侵权纠纷案件管辖所涉及的案件范围、管辖界定标准以及法律适用现存问题,需要进一步厘清网络知识产权侵权纠纷案件管辖的特殊性,规范网络知识产权侵权纠纷管辖多连接点规则,规制当事人滥用管辖程序等恶意拖延诉讼行为,并出台网络知识产权侵权纠纷案件管辖配套规定。There are many uncertainties in determining the jurisdiction of network intellectual property infringement disputes,which leads to the increasing complexity of the jurisdiction of network intellectual property infringement disputes.It should be clearly recognized that the jurisdiction of the case is a key factor to ensure the fair,efficient and orderly operation of the specific case,and is crucial to the maintenance of the legal order and the legitimate rights and interests of the parties.In view of the scope of cases involved in the jurisdiction of network intellectual property infringement disputes,jurisdiction definition standards and existing problems in the application of law,it is necessary to further clarify the specificity of the jurisdiction of network i ntellectual property infringement disputes,standardize the rules of network intellectual property infringement disputes,regulate the abuse of the jurisdiction of the parties to the procedure of maliciously delaying the litigation,and the introduction of the network of intellectual property infringement disputes,the jurisdiction of the supporting provisions.
