摘　　要：网络犯罪侦查公私合作是侦查机关与网络信息业者合作开展侦查治理工作的新模式。基于网络犯罪治理的复杂性和网络信息业者在协查上的特殊优势,公私合作已经成为重要的网络犯罪侦查模式。虽然网络犯罪侦查公私合作具有一定的立法和实践基础,但在程序合法、权力泛化和企业数据合规等方面仍存在一些困境。网络信息业者的侦查协助义务与其他义务在法律框架下未形成体系化结构是造成困境的主要原因。我国有必要界定网络信息业者协助侦查的权力边界,明确不同义务履行的优先顺序,健全相关的企业数据合规方案和监督救济机制,从而形成保证网络犯罪侦查程序有效运行的规则体系。The public⁃private partnership in cybercrime investigation is a new pattern of cooperation between the investigation organs and the network information operators in obtaining evidence.Due to the complexity of cybercrime management and the special advantages of network information operators in collaborative investigation,public⁃private partnership has become an important pattern of cybercrime investigation and forensics.Although public⁃private partnership in the investigation of cybercrime has a certain legislative and practical basis,there are still problems in terms of procedural legality,generalization of powers and corporate compliance.The lack of a systematic structure of investigative assistance obligations and other obligations of cyber informatics operators under the legal framework is the main reason for these dilemmas.It is necessary to define the boundaries of the authority of network information operators to assist in investigations,clarify the order of priority for the fulfillment of different obligations,and improve relevant corporate compliance plans and monitoring and relief mechanisms,so as to form a regulatory system that ensures the effective operation of cybercrime investigation procedures.
