摘　　要：我国法律、司法解释、司法规范文件、指导性案例等不同位阶的规范中关于追诉时效的规定总数适中、总体合理,运用类型化思维、标准化思维、系统思维、建模法和思想试验法,足以归纳出公正合理、简便易行的规则体系。在归纳规则体系的过程中,应当遵循法秩序统一原理、坚持逻辑一致性,对相关规定进行再发现,尽可能将规则体系与现行规范之间的矛盾控制在最小限度。我国不存在追诉时效延长和中止制度,需要区分追诉时效和追诉时效期限,明确追诉时效的适用步骤与规则、合理界定影响因素,关于追诉时效终点宜采“二分法说”,并完善核准追诉制度。国家监察委员会、最高人民法院、最高人民检察院和公安部等联合制定“追诉时效制度司法适用指引”很有必要。The total number of provisions on the limitation of prosecution in China’s laws,judicial interpretations,judicial normative documents,guiding cases and other provisions on the limitation of prosecution is moderate and generally reasonable.The use of typification,standardization,systematic thinking,modeling method and ideological test method is enough to summarize a reasonable and simple rule system.In the process of induction,the order of law should be unified and the logic should be consistent,the relevant provisions should be rediscovered,and the contradiction between the rule system and the current norms should be controlled to the minimum.There is no system of extension and suspension of the limitation of prosecution in China.It is necessary to distinguish the limitation of prosecution and the limitation period of prosecution,clarify the applicable steps and rules of the limitation of prosecution,reasonably define the influencing factors,adopt the“dichotomy theory”at the end of the limitation of prosecution,and improve the approval of the prosecution system.It is necessary for the National Supervisory Commission,the Supreme People’s Court,the Supreme People’s Procuratorate and the Ministry of Public Security to jointly formulate the“Guidelines for the Judicial Application of the Limitation of Prosecution System.”
