摘 要:我国海洋渔业资源丰富,地理位置得天独厚。充分利用海洋渔业资源是贯彻落实习近平总书记“大食物观”的具体举措。目前,我国海洋渔业资源利用效率不足,相关法律制度有待完善。本文从习近平总书记“生态文明”的观点出发,梳理了“大食物观”背景下我国海洋渔业资源及其法律制度现状;分析了海洋渔业资源法律制度实施过程中存在的问题;提出了加快构建具有独立性地位的海洋渔业法律体系,适时适事适当承认海洋渔业多元治理主体法律地位,借鉴域外先进经验完善休渔期制度的建议。China has abundant marine fishery resources and a unique geographical location.Fully utilizing marine fishery resources is a specific measure to implement the all-encompassing approach to food.At present,the utilization efficiency of marine fishery resources in China is insufficient,and the relevant legal system needs to be improved.This article starts from the perspective of ecological civilization,and summarizes the current status of China's marine fishery resources and legal system under the background of the all-encompassing approach to food.It analyzes the problems that exist in the implementation process of the legal system for marine fishery resources.Suggestions have been put forward to accelerate the construction of an independent legal system for marine fisheries,recognize the legal status of diverse governance entities in marine fisheries in a timely and appropriate manner,and draw on advanced experience from outside the region to improve the fishing ban system.
