铸牢中华民族共同体意识的司法保障:法理内涵和机制路径

摘　　要：法治是提升民族事务治理体系和治理能力现代化水平的重要保障,“铸牢中华民族共同体意识的法治保障”需要司法基础理论加以回应。在中国司法语境下,“中华民族共同体”的法理内涵包括:司法为民的感知共同体、中华司法文化的文化共同体、边疆司法的命运共同体和司法治理的参与共同体。公权主体的一体性逻辑、司法权的中央事权属性、司法场域的主体间性关系、中华司法文化的和谐取向、国族一体的宪制规范构成了司法铸牢中华民族共同体意识的组织结构基础、公众认知基础、主体关系基础、和谐语境基础和规范结构基础。基于“中华民族共同体”的法理内涵及司法对铸牢中华民族共同体意识保障作用的内在机理,建构铸牢中华民族共同体意识的基层司法保障路径。The rule of law is a vital guarantee for modernizing the governance system and enhancing governance capabilities in ethnic affairs.Developing a robust community consciousness for the Chinese nation,rooted in the rule of law,necessitates a response from fundamental legal theories.In the context of Chinese jurisprudence,the legal essence of the“Chinese National Community”encompasses:a community perception of judicial fairness,a cultural community within Chinese judicial culture,a shared destiny in frontier judiciary,and a participative community in judicial governance.The cohesive understanding of public authority,the central role of judicial power,the intersubjective dynamics in judicial fields,the harmonious direction of Chinese judicial culture,and the constitutional norms uniting nation and ethnicity,together form the structural,cognitive,relational,contextual,and normative foundations for the judiciary's role in cultivating a strong sense of community for the Chinese nation.Based on the legal essence of the Chinese national community and the judiciary's internal mechanisms for safeguarding this consciousness,this paper proposes a practical approach for grassroots judicial systems to reinforce this community sense.
