摘　　要：伴随着全球化的深入推进,民间文学艺术保护日益重要,加快推进我国民间文学艺术保护立法迫在眉睫。从价值基础的一致性、理论依据的贯通性与实践要求的符合性三个方面来看,构建民间文学艺术表达专有权不失为一条切实可行的路径。民间文学艺术的开发和利用应符合来源群体特定的传统与习惯,在遵循来源群体知情同意原则的同时,应保障来源群体对他人利用民间文学艺术表达获得的惠益。在此基础上,创设以民间文学艺术表达来源群体为权利主体,经审查认定的民间文学艺术表达为权利客体的精神权利、以事先知情同意和事后开发利益分享为内容的经济权利,但应对上述权利做合理限制。应根据民间文学艺术的特点,确定适当的保护期限和救济规则。With the deepening of globalization,the protection of folklore is becoming more and more important,and it is urgent to accelerate the legislation on the protection of folklore in China.From the three aspects of the consistency of val-ue basis,the consistency of theoretical basis and the conformity of practical requirements,it is a practical and feasible way to construct the exclusive right of expression of folklore.The development and utilization of folklore should conform to the specific traditions and habits of the source group,and follow the principle of informed consent of the source group,and at the same time,it should ensure that the source group benefits others from using expressions of folklore.On this basis,with the source group of expressions of folklore as the subject of the right,folklore recognized by the examination as the object of the right,moral rights and economic rights based on prior informed consent and post-development interest sharing as the content should be created,but the reasonable limitations should be set.According to the characteristics of the expression of folklore,the appropriate protection period and relief rules should be determined.
