双重秩序视角下的网络平台监管及其制度完善

摘　　要：平台企业除具备一般市场主体身份外,还具有平台内活动的组织者与治理者身份,这为平台带来了不同于公权力的独特“私权力”。以法律规范规制为主导的“法律秩序”和以平台自治规范调整为主导的“平台秩序”组成的双重秩序,反映了平台经济的特点和治理规律。随着网络平台“法律秩序”不断趋严,网络平台监管要把握好时代需求,找准自身定位。完善的网络平台监管需要在把握双重秩序规律的基础上,回应由“公权力--私权利”到“公权力--私权力--私权利”的格局变化。网络平台监管既要在公私主体间科学配置责任义务,均衡约束公私权力,也要创造平台企业积极参与监管的环境,优化合作监管机制,还要在坚持底线的基础上审慎调控“平台秩序”,推动“法律秩序”与“平台秩序”良性互动。Beyond their identity as standard market entities,platform companies possess another identity as organizers and governors within the platform,endowing them with a unique"private power"distinct from public authority.The dual order composed of the"legal order",dominated by legal norms,and the"platform order",led by the platform's autono-mous norms,mirrors the characteristics and governance regularities of the platform economy.As the"legal order"in inter-net plaform becomes increasingly stringent,internet platform regulation must adapt to the demands of the era and find its precise role.Perfecting internet platform regulation involves understanding the regularities of this dual order and responding to the structural shift from"public authority-private rights"to"public authority-private power-private rights".This re-quires scientifically allocating responsibilities and obligations between public and private entities,balancing the constraints on both public and private power,creating an environment for active plaform companies participation in regulation,optimi-zing cooperative regulatory mechanisms,and,while maintaining fundamental principles,carefully adjusting the"platform order"to promote constructive interactions between the"legal order"and the"plaform order".
