摘　　要：对遗传资源惠益分享制度现状进行分析,发现中医药服务贸易目前存在遗传资源惠益分享主体仍需明确、遗传资源惠益分享渠道尚未建立、遗传资源惠益分享制度监管机制不到位等问题。提出了构建中医药遗传资源行政许可与备案制度、设置中医药遗传资源信息使用许可权、推行中医药遗传资源惠益分享示范性合同等建议,以期对推进中医药服务贸易中的遗传资源惠益分享工作进程提供参考。By analyzing the current situation of the system of benefit sharing of genetic resources,it is found that the main body of benefit sharing of genetic resources still needs to be clarified;the channel of benefit sharing of genetic resources has not been established,and the regulatory mechanism of the system of benefit sharing of genetic resources is not in place in TCM service trade.Suggestions are put forward to construct the administrative licensing and filing system for TCM genetic resources,set the permission for the use of information of TCM genetic resources,and carry out the model contract of benefit sharing of TCM genetic resources,so as to provide the reference for promoting the process of benefit sharing of genetic resources in TCM service trade.
